You must be at least 18 years of age to use our Services. By accepting these Terms, you confirm that you are 18 years or older. If you are under 18, you may only use our Services with the involvement and consent of a parent or legal guardian who must complete the acceptance process on your behalf.

6. Fees and Payment

All fees for Services are payable in Thai Baht (THB). By proceeding with payment, you agree to pay all applicable fees. All fees are non-refundable unless otherwise specified in writing. We reserve the right to modify our fees with 30 days' notice.

7. Cancellation and Rescheduling

Appointments must be cancelled or rescheduled at least 24 hours in advance. Late cancellations or no-shows may result in forfeiture of the session fee.

8. Confidentiality and Privacy

We respect your privacy and will handle your personal information in accordance with applicable Thai data protection laws. We will not share your personal information with third parties without your consent, except as required by law. By accepting these Terms, you consent to our collection and use of your information as described.

I understand that my data may be shared only with [SoWell’s Partners]’s professionals and contracted laboratory partners for diagnostic and service delivery purposes, and that I may withdraw my consent at any time.

9. Intellectual Property

All materials, protocols, documents, and content provided as part of our Services are our intellectual property and are protected by copyright laws. You may use these materials for your personal use only and may not reproduce, distribute, or commercialize them without our written permission.

10. Results and Guarantees

Results from sleep protocols vary by individual. We make no guarantees regarding specific outcomes or improvements. Your commitment to following the protocol and individual factors will affect your results.

11. Limitation of Liability

To the fullest extent permitted by Thai law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use of or inability to use our Services

• Any adverse reactions or health issues arising from following the sleep protocol

• Any errors or omissions in the content provided

Our total liability shall not exceed the amount you paid for the Services in the six months preceding the claim.

12. Indemnification

By accepting these Terms, you agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our Services or violation of these Terms.

13. Assumption of Risk

You acknowledge that following a sleep protocol involves certain risks, including but not limited to: changes in sleep patterns, temporary fatigue, adjustment difficulties, or unforeseen reactions. By accepting these Terms, you voluntarily assume all such risks.

14. Termination

We reserve the right to terminate or suspend your access to our Services at any time, with or without cause or notice, including if you breach these Terms.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Thailand, or resolved through mediation or arbitration as mutually agreed.

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through our website. Your continued use of our Services after such modifications constitutes acceptance of the updated Terms.

17. Severability
